Level Up is operated by Logan ("Logan", "we", "us"). These Terms & Conditions ("Terms") form an agreement between you and Logan when you use the Level Up website and app (the "Service").
By creating an account or continuing to use the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation; if you use it as an individual, you confirm you are of legal age or have your guardian's permission.
Level Up is a gamified productivity app that lets you earn XP for real-life activities, level up, keep streaks, unlock achievements, set goals and manage daily quests. Advanced Mode is a paid subscription that adds extra features, described on the Advanced Mode page.
You are responsible for keeping your sign-in credentials confidential and for all activity that happens under your account. You must provide accurate information and keep it up to date.
You agree not to misuse the Service. That means you must not: use it for any unlawful purpose; commit fraud or send spam; infringe anyone's intellectual property; interfere with the Service's security, including introducing malware, probing or scraping the Service; or attempt to circumvent technical limits or gain unauthorised access.
We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. You may not reverse engineer the Service, resell or redistribute it, or use it to build a competing product.
You keep ownership of the activities, goals and other content you create. You grant us a limited licence to host and process that content solely to provide the Service to you.
Logan retains all ownership of the Service, including its software, design, branding and documentation. Nothing in these Terms transfers those rights to you.
Advanced Mode is billed as a subscription at the price shown on the Advanced Mode page. For payment, billing, tax, renewal, cancellation and refund mechanics, the order process and Paddle's Buyer Terms apply: https://www.paddle.com/legal/checkout-buyer-terms. You can cancel your subscription at any time.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
The Service is provided "as is". We do not guarantee that it will be uninterrupted, error-free, or that game data will never be lost. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. When your access ends, you can export your data for a reasonable window, after which it may be deleted.
To the fullest extent permitted by law, Logan is not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability is capped at the fees you paid us in the six months before the claim. Nothing in these Terms limits liability for fraud, death or personal injury where such limitation is not permitted by law.
You agree to indemnify Logan against claims arising from content you submit, your unlawful use of the Service, or your breach of these Terms.
You may not assign these Terms without our consent. We may assign them in connection with a merger or acquisition of our business.
We are not liable for delays or failures to perform caused by events beyond our reasonable control.
These Terms are governed by the laws of the seller's place of establishment, and the courts of that place have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.
We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms.
